Constitutionality of Regional Investment Regulation and Its Impact on The Local Economy of Malang Regency

Abstract

This study aims to analyze the constitutionality of regional investment regulation in Malang regency and its impact on the local economy. Regional investment is expected to promote equitable economic growth, but the implementation of existing regulations often faces challenges related to the balance between investor interests and community rights. The approach used in this study is a normative approach with a qualitative analysis of the legislation in force, as well as an evaluation of the social and economic impact of investment regulations applied. The results showed that although the existing regulations in Malang are generally in accordance with constitutional principles, there is an imbalance in their application that leads to social and economic disparities. Some sectors, such as tourism and infrastructure, benefit greatly from investment, but these benefits have not been equally felt by local communities, especially in the agricultural and MSME sectors. This study recommends that regional investment policies pay more attention to aspects of social sustainability, equitable distribution of benefits, as well as the active involvement of local communities in the investment process. Thus, fair and sustainable investment regulations can support the achievement of more equitable and equitable economic development in Malang regency.
